Schuett <br /> Current Planner <br /> Department of Planning Services <br /> 915 10th Street <br /> Greeley, CO 80631 <br /> Re: Varra Companies , Inc. , Amendment No. 2, Permit No. M-74-052 <br /> Dear Mr. Schuett: <br /> The Division has received your letter requesting the Colorado Mined Land <br /> Reclamation Board to deny approval of the Amendment No. 2 , Permit No. M7-74�_52_ <br /> until the applicant first obtained in amended Special Review permit from the <br /> county under Rule 34-32-115(4) of the Colorado Mined Land Reclamation Act . <br /> The Division has not received an amendment to the Dakolios Permit M-84-036. <br /> The Division is constrained from denying a permit by the following ruYeS—from <br /> the Mineral Rules and Regulations (34-32-115) : <br /> (4) The Board shall grant a permit to any operator if the application <br /> complies with the requirements of this article. The Board shall not deny a <br /> permit, except for one or more of the following reasons: <br /> (a) The application is incomplete or the performance and <br /> financial warranties have not been provided. <br /> (b) The applicant has not paid the required fee . <br /> (c) Any part of the proposed mining operation , the reclamation <br /> program, or the proposed future use is contrary to the laws or regulations of <br /> this state or the United States . <br /> (d) The mining operation will adversely affect the stability of <br /> any significant, valuable, and permanent man-made structures located within <br /> two hundred feet of the affected land, except where there is an agreement <br /> between the operator and the persons having an interest in the structure that <br /> damage to the structure is to be compensated for by the operator. <br /> (e) Repealed, L. 88 p. 1215, sec . 16, effective July 1 , 1988. <br /> (f) The mining operation is located upon lands : <br /> (I) Where mining operations are prohibited by law or <br /> regulation within the boundaries of units of the national park system, the <br /> national wildlife refuge system, the national system of trails , the national <br /> wilderness preservation system, the wild and scenic rivers system, or national <br /> recreation areas ; <br /> i <br />
