M-1998-014~jti{-~R _2 ~~spa-1-l-~ v~ <br />Deaz Steve: <br />Accompanying is a partial response to your second adequacy review dated January 7, 2004 that <br />was received on January 9, 2004. The following exhibits were modified in accordance with your <br />request: <br />Exhibit A, sheet 1 of 1 <br />Exhibit D, page 3, page 7 and 8 <br />Exhibit E, page 2 <br />Exhibit F, sheet 1 of 4, sheet 2 of 4, sheet 3 of 4 <br />Your second adequacy review raised several issues that require additional input from you: <br />1. It is my opinion that Exhibit C, sheet one of five, provides the required vegetation <br />information, if this is not the case, provide me with a detailed outline of the information <br />that is needed to be depicted on the exhibit. <br />2. The submitted estimate included the hauling and placing a maximum of 30,000 tons of <br />concrete rubble in the slopes whhin the pit area. Is this satisfactory with the Division, or <br />do we need to estimate the cost to remove the material from the site and disposal a[ an <br />approved landfill? <br />3. I have not received a copy of the Army Corps of Engineers letter dated March 13, 2003. <br />This can be faxed to me at 434-0676. <br />4. The bottom of the proposed stotmwater sediment pond in Phases 2 and 3 will be situated <br />approximately 12 inches above a bedrock layer and will be contained with a maximum six <br />foot high berm between the pond and the slope above the river. According to the <br />Overburden Stockpile Study, conducted by the Division, the bedrock layer is not prone to <br />failure. If the Division is still not at ease with the location of the pond, notify me in order <br />to develop an alternative for dischazge of the storm water to the river as a replacement for <br />the proposed retention basin <br />
