The request is for that part of the permit areas referred to as
Phase 1. At this time United Companies requests that this company be relieved of all
responsibility for further reclamation of this site. We believe that we have satisfied our
responsibilities to return the land to the post mining land use that is expected at this Phase
I site. United Companies requests that all responsibilities enumerated in our Performance
Warranty for this site are considered fulfilled for the Phase I area. United Companies also
requests that the Reclamation Bond that has been put in place for the reclamation of this
permit site be reduced to reflect the smaller area of affected land that remains active.
Liberty Mutual Insurance Company issued bond # in the amount of
$194,850.00 to cover 119.8 acres (Amendment 1 total area). The area referred to as Phase
I is approximately 61.65 acres or 51.4% of the total 119.8 acres permitted. We expect
that the Division will recalculate the bond amount if the permitted area is changed.
When Amendment 1 for this permit was issued, the area that was referred to as Phase 1 in
the Amendment 1 application was essentially mined out. Mining and reclamation have
now been completed at the Phase 1 area.
The landowner has a buyer for the land for which this release of reclamation
responsibility is being requested. The land is being sold to a company engaged in the
asphalt pavement construction and maintenance business. The firm intends to use the site
for a company headquarters. Their office, equipment maintenance, equipment storage and
material storage functions will be based at this location. In addition the RV campground
will be offered for employee use during the construction season. The City of Rifle will
also be involved with the site's g land use. The City will be using the west lake
as the new water intake location for its water treatment plant.
The Operator is confident that all applicable portions of the Reclamation Plan
requirements have been satisfied in accordance with the Construction Materials Rules
~n-~G~rCU~~ne~~tt~ ; NOt~~
~:F, = S~f5~02
