CONDITIONS OF APPROVAL <br />RIO BLANCO COUNTY EAST DOUGLAS PIT <br />PARTS OF T2S, R101W, SEC .36 AND T3S, R101W, SEC 1 <br />1. AIR QUALITY. Fugitive dust shall be controlled during <br />excavation and crushing activities. <br />2. CULTURAL RESOURCES. if, during its operations, the operator <br />discovers any cultural remains, monuments or sites, paleontological <br />sites, or any object of antiquity subject to the Antiquities Act of <br />June 8, 1906 (34 Stat. 225; 16 U.S.C. secs. 431-433), the <br />Archaeological Resources Protection Act of 1979 (Public Law 96-95), <br />NHPA, of 1966, Mineral Leasing Act of 1920, or 43 CFR, Part 3, <br />activity shall immediately cease and the Area Manager notified. The <br />BLM will then take such action as required under t2~e acts and <br />regulations thereunder. The operator shall follow 'the mitigation <br />requirements set forth concerning protection, preservation, or <br />disposition of any sites or material discovered. In cases where <br />salvage excavation is necessary, the cost of excavation shall be borne <br />by the holder, unless otherwise stated. <br />3. SOILS. The area contains fragile soils on slopes greater than 35 <br />percent and saline soils. Surface disturbing activities will be <br />allowed in these areas only after an engineered construction- <br />reclamation plan is submitted by the operator and approved by the Area <br />Manager. The following items must be addressed in the plan: i) How <br />soil productivity will be restored; 2) How surface runoff will be <br />treated to avoid accelerated erosion such as riling, gullying, piping, <br />and mass wasting. when preparing the site, all suitable topsoil <br />should be stripped from the surface of the location and stockpiled for <br />reclamation once the location is abandoned. when topsoil is <br />stockpiled on slopes exceeding five percent, construct a berm or <br />trench below the stockpile. <br />4. EXISTING RIGHTS-OF-WAY. The owners of linear Right-of-Way <br />(pipelines, phone lines) crossed in the process of establishing this <br />pit shall be contacted for special conditions, if necessary, prior to <br />initiating surface disturbing activities. <br />5. NOXIOUS-PROBLEM WEEDS. The permittee is responsible for the <br />control and containment of noxious weeds and undesirable plant species <br />associated with this permit. <br />6. HAZARDOUS MATERIALS. Berms shall be placed so that inadvertent oil <br />or fuel spills will be diverted and contained on site. <br />7. RECLAMATION. Reclamation should be implemented concurrent with <br />construction and site operations to the fullest extent possible. <br />Final reclamation actions shall be initiated within six months of the <br />termination of operations unless otherwise approved. Disturbed areas <br />shall be restored as .nearly as passible to the original contour. <br />Distribute stockpiled top soil evenly over the disturbance and prepare <br />a seedbed by disking or ripping. Drill seed on contour at a depth no <br />greater than 1/2 inch. Seed disturbed areas with Western wheatgrass <br />(Arriba) 3 lbs/acre, Pubescent wheatgrass (Luna) 2 lb/acre Russian <br />wildrye (Bozoisky) 2 lbs/acre, Crested wheatgrass (Fairway/Ephraim) 2 <br />lbs/acre, Yellow sweetclover (Madrid) 0.5 lbs/acre, and Fourwing <br />saltbush (Wytana/Rincon) 2 lbs/acre. <br />
