This memorandum provides a summary and update of <br />the status of the permit amendment application. <br />Proposal to Reclaim the Tailint Impoundment usiu¢ a Wet Cover <br />Initially, the amendment application requested approval of an alternative reclamation plan for the <br />tailing impoundment where a free water pond would occupy the western 70 percent of the <br />impoundment with the remaining 30 percent of the impoundment and the dam face covered with <br />plant growth media and revegetated to rangeland. Discussions between Henderson and the Division <br />of Minerals and Geology (DMG) leading up to the submittal of the amendment application <br />specifically addressed the incorporation of the wet cover into the reclamation permit as being both <br />alternative to the previously approved reclamation plan and conceptual in natwe. This is because <br />until designs addressing the engineering and hydrologic issues involved in a wet cover reclamation <br />project are prepared by Henderson, and reviewed and accepted by DMG there can be no reasonable <br />assurance that the project will be implemented or even feasible. Alternative reclamation plans are <br />addressed in the Hazd Rock/Metal Mining Rules and Regulations of the Mined Land Reclamation <br />Board at rule 6.4.5(2)(b). Under this regulation, until such time that the implementation of the <br />alternative post mining land use is reasonably assured, the existing plan remains the primary plan <br />for implementation, and is the plan upon which the amount of reclamation bond is established. As a <br />result, Henderson is required to implement the dry cover plan until such time that a wet cover plan <br />may be approved and properly bonded.
