Pre-Hearing Order Issue: One of the three (3) issues for Board Consideration listed in the <br />Division's February 2, 2004 Pre-Hearing Order is "Has the applicant provided a statement <br />identifying which permits, licenses and approvals they will be seeking in order to conduct the <br />proposed mining operation?" VCI has provided an Exhibit M which lists five (5) separate <br />permits necessary as part of the proposed operation. Please review the exhibit provided and <br />revise, as necessary, to include any other permits & licenses or approvals (such as NPDES <br />Permit, OSE Permits) needed to conduct the proposed operation. Please respond. <br />Exhibit M -Other Permits and Licenses, indicates the following permits will be pursued as <br />part of this, or as a consequence of this Amendment application: <br />The Following Permits are Existing: <br />• Colorado Department of Health Storm Water Discharge (NPDES) Permit COG500100. <br />• Colorado Department of Health Emission Permii 89WE350 -Concrete Batch Plant. <br />• Colorado Department of Health Emission Permit 98P00065 -Portable Equipment -Dry <br />Plant <br />• Colorado Department of Health Emission Permit O1 WE0946 -Wet Plant <br />• Colorado Department of Health Emission Permit -02WE0259F -Fugitive Dust -Mining <br />Operations and related activities. <br />• Weld County Special Use Permit 345 -This will occur only to the extent determined by <br />the Weld County Board of Commissioners. All ancillary permits required by Weld <br />County are not included as part of the DMG submittal. <br />Additional Permits not previously specified under Exhibit M, and needing clarification <br />include: <br />1) U.S. Army Corps of Engineers - 404 -Wetland Permits -cleared via correspondence of <br />30 March 2004 (previously submitted) <br />2) Substitute Supply Plan -Colorado Division of Water Resources -approved through <br />October 2005. <br />3) Well Permit -Colorado Division of Water Resources -Pending OSE Hearing <br />4) FEMA/Weld County Colorado County Commissioner approval of Floodway <br />Remediation, if necessary, including a No Rise Certificate -Pending and under the <br />supervision of Anderson Consulting Engineers <br />5) Colorado Department of Labor - -Division of Oil and Public Safety. <br />Vaasa Companies, Inc.
