Therefore, exposure of ground <br />water must not occur during or after mining operations. <br />® The proposed operation will consume ground water by: ®evaporation. There is no additional exposed <br />ground water or impacts on the existing water rights due to this proposed amendment. Corinell <br />Resource, Inc. has indicated that the reclamation plan will no longer include a groundwater lake and that <br />the reclamation plan now consists of backfilling the mine pit to create general agricultural property. <br />® A well permit was obtained for the current use and exposed pond surface area of the gravel pit, permit <br />no. 42334-F in accordance with Section 37-90-137(2) and (11), C.R.S. A substitute water supply plan is <br />currently pending. Now that the reclamation of the mine site is amended to account for backfilling of the <br />site, replacement of lagged depletions must continue until there is no longer an effect on stream flow. <br />^ The proposed operation may have potential impact on existing water rights near the project location. <br />Applicant needs to demonstrate that the proposed project will not alter or impact the historic operation of <br />existing water rights. <br />^ The applicant has indicated plans to use other water for purposes at the permit site. The source <br />of water for this use is to be obtained from Applicant needs to document that this water was <br />diverted in priority under a water right decreed for such industrial use. Applicant should contact the <br />water commissioner for further information. <br />® It is indicated that that a small portion of the mining area will not be completely backfilled and that area <br />will be lined to create a dry depression in the land surface that could potentially be used as a stock pond. <br />However the proposal to create a lined pond is not part of this amendment..-If reclamation of the mine site <br />is amended to include a lined pond, then replacement of evaporation and lagged depletions must <br />continue until there is no longer an effect on stream flow and the lining was approved by the Division 1 <br />Office. <br />COMMENTS: If stormwater runoff is intercepted by this operation and is not diverted or captured in priority, it <br />must be released to the stream system within 72 hours. This may require a discharge permit from CDPHE- <br />WOCD. Otherwise, the operator will need to make replacements for evaporation. <br />The applicant may contact the State Engineer's Office with any questions. <br />
