Smith Pit #5 -Permit No. M-1981-309, Bond Calculation for Succession of <br />Operator Application <br />Dear Mr. King, <br />The Division of Minerals and Geology received your Succession of Operator application, on <br />May 26, 2006, In response to this application, the Division performed an inspection on June 28, <br />2006 and filed the enclosed report. <br />The enclosed bond calculation estimate is based on the findings during the inspection and the <br />approved reclamation plan (also enclosed) filed with the state for this site. Please be advised that <br />all Corrective Actions listed on page 3 of the inspection report will become the responsibility of <br />the successor operator (Mason A. King) in the event that the Succession of Operator Approval <br />(decision date is set as July 24, 2006) takes place before the corrective action deadline (August 1, <br />2006}. <br />Please note, once the approved permit boundaries have been mazked (per corrective action No. 1 <br />in the inspection report), if it is found that mining has occurred outside of the approved permit <br />boundaries, the current operator will be responsible for the consequences of this possible <br />violation. <br />In addition, a map of the approved permit area must be provided to the Division by the current <br />operator (Washington County) prior to Succession of Operator application approval. <br />In order to complete this Succession of Operators transfer, a bond in the amount of $7,849.00 <br />must be posted to the Division by July 24, 2006. Information regazding the Division's bond <br />procedure will follow this letter under sepazate cover. If this bond amount is not provided by July <br />24, 2006, this Succession of Operators application will be denied. <br />If more time is needed to obtain the bond and/or complete the specified corrective actions, the <br />Division can grant an extension to the decision date. This will be done upon receipt of a written <br />waiver of your right to a decision by July 24, 2006 and request for additional time.
