frequency, the Operator should submit a Technical Revision request indicating the change in <br />sampling frequency. At that time the Division will review prior sampling results and <br />determine whether reduced sampling frequency is appropriate. The Division believes that <br />sampling of A-Pit water should continue throughout the life of C-Pit due to wildlife usage of <br />A-Pit. <br />Additionally, the Division continues to have two concerns over the water in C-Pit. First, <br />CEMEX has not yet identified how it will reduce the pH and selenium levels in the water <br />existing in the pit. Although CEMEX plans to reduce the amount of water in the pit, which <br />will then no longer be in contact with the CKD in the pit, the remaining water will still need <br />have the selenium and pH levels lowered to acceptable levels. Secondly, CEMEX plans to <br />~- mamtairi a certain amounfof water iri GPiti for processing. At the same time, CEMEX <br />proposes to ultimately completely fill C-Pit with CKD prior to its closure. CEMEX has not <br />identified how it will keep the water, intended for processing, in C-Pit from contacting the <br />ever-increasing amount of CKD in the pit. In addition, retaining water in the pit (without any <br />form of treatment) is in contradiction to the wildlife assessment report that states that C-Pit <br />water will be eliminated. <br />8. Rule 6.2.1(2) requires that maps be signed by a registered land surveyor, professional <br />engineer, or other qualified person. The maps submitted to the Division were not signed. <br />Please resubmit a signed copy of the maps. <br />Please be advised that Division's decision due date is set for December 1, 2004. If you feel more <br />time is needed to complete your reply, the Division can grant an extension to the decision date. This <br />will be done upon receipt of a written waiver of your right to a decision by December 1, 2004 and <br />request for additional time. This must be received no later than the deadline date.
