Riverbend Operation 112c <br />Permit Amendment Ol, Permit No. M-2000-016 t/ <br />Deaz Mr. Mount: <br />On behalf of Lafage West, Inc., we are writing to request a waiver of the 90 day decision rule <br />for this application and request that the October 27, 2005 decision date be extended until <br />November 4, 2005. Pursuant to MLRB Rule 1.4.1(9), we require additional time to provide the <br />supplemental documentation requested (signed agreements with the Lupton Bottom Ditch <br />Company and Brighton Ditch Company) in the Division's Seventh Adequacy Review. <br />Below, we have provided responses to address the Division's concerns raised in the seventh <br />adequacy review dated October 11, 2005. Below you will find the Division's comments are <br />quoted in italics and followed by our response. <br />ADEQUACY REVIEW #7 <br />1. In an attempt to fulfill the requirements of Rule 3.1.6(1) of the construction Materials Rules <br />and Regulations, which requires that disturbances to the prevailing hydrologic balance of <br />the affected land and to the surrounding area and to the quantity and quality of water in <br />surface and groundwater systems both during and after the mining operation and during <br />reclamation shall be minimized, the division has been working with Lafarge and Tetratech <br />RMC to establish a monitoring plan that should protect the interests of well owners and <br />vegetation in the area of the project. On October 6, 2005, a meeting was held at the Denver <br />office of the DMG to address these issues. A monitoring plan with mutually agreed upon <br />monitoring well locations and time schedules relative to mining at the site was established. <br />Please submit the monitoring plan established as a result of this meeting. <br />The revised monitoring plan was submitted to the Division on October 12, 2005. Since that <br />submission we had a conference call with Carl Mount on Tuesday, October 18, 2005. The <br />Division requested that, recharge basins be installed on the north side of Cell 1, Phase 7 and <br />the east side of Cell 1, Phase 8 to mitigate anticipated disturbance of the prevailing <br />hydrologic balance.
