~} ~ ~ <br />Sally Hayes <br />-2- <br />August 8, 1995 <br />The Division proposes to mitigate the situation with a conditional approval unless BMR.I can <br />resolve the saturated tailings problem some other way. In order that BMRI be allowed to <br />proceed with the construction of Phase 1I raise 2 utilizing Type 1 embankment fill material, as <br />approved for raise 1 (not the Type 1 material set forth in SRK's report) and in amformance <br />with all of the permit requirements such as lift thickness, amount of compaction, etc, BMRI <br />must commit to a 150 foot free water pool setback from the embankment raise, and install <br />settlement mazkers as se[ forth on pages 18 and 14 of Appendix A in the SRK report. The <br />mazkers must be monitored daily for 2 weeks, once a week thereafter for 2 '/: months, then <br />once a month for 3 more months (for a total of 6 months) after construction of Raise 2. If <br />more than .5 feet of settling is observed at any of the marker stations BMRI will notify the <br />Division within one week after observing the settlement. BMW will submit a report to the <br />Division once a month for the six month period. The mazkers will not be removed or <br />disturbed after the monitoring period in case there is a need for future monitoring. <br />As a final condition of approval, the Division will require BMRI to initiate an emergency <br />response plan, as part of the environmental protection plan (TR-022), in regazds ro emergency <br />action reporting immediately after the occurrence of an earthquake as follows: <br />1. BMRI shall notify the Division by 4:00 p.m. of the next work day following a <br />magnitude 4-5 earthquake with an epicenter at or within a 50-mile radius of the <br />tailings facility. The mine Operations Manager shall inspect the tailings <br />embankment and report any visual damage to the Division. If any damage has <br />occurred it will be repaired and the embankment will be recertified. <br />2. BMW shall notify the Division by 4:00 p.m. of the next work day following a <br />magnitude 5.]-6 earthquake with an epicenter at or within a 100 mile radius of <br />the tailings facility. The mine Operations Manager shall inspect tt~e tailings <br />embankment and report any visual damage to [he Division. BMR] shall retain <br />the services of a registered professional engineer to inspect and evaluate any <br />damage to the tailings embankment and submit a report to the Division. Upon <br />approval from the Division, the structure will be repaired and recertified. In <br />addition, BMRl shall contact the Costilla County Sheriff, the Mayor of San <br />Luis, and the Costilla County Administrator (phone numbers are located in the <br />EPP) and inform them of the damage assessment at the San Luis Project <br />facility within 72 hours after a seismic event. <br />3. In the event of a magnitude 6.1 or greater earthquake with an epicenter at or <br />within a 200 mile radius of the tailings facility, BMR1 shall follow the same <br />notification, inspection, and reporting procedures for the M = 5.1-5 earthquake <br />(pazagraph number 2 above). BMRI can contact the National Earthquake <br />Information Center at (303) 273-8500 or 1-800-525-7848 for magnitude and <br />epicenter information. <br />
