Cattany <br />Division Director <br />Natural Resource Trustee <br />The Division of Minerals and Geology received your Technical Revision Application (TR-04) to the Challenger <br />Pit, Permit No. M-1985-026. The operator proposes reclaiming the Challenger Pit into three groundwater- <br />exposed lakes; 14 acres, 3 acres and 3 acres. Because the operator no longer proposes to leave one of the lakes <br />lined, the Division concurs that the change in the reclamation plan may be filed as a technical revision to the <br />permit rather than an amendment to the permit. The Division has the following comments; <br />1. Rule 6.2.1(2) requires that maps be signed by a registered land surveyor, professiottai engineer, or <br />other qualified person. The maps submitted to the Division were not signed. Please resubmit a <br />signed copy of the maps. <br />2. The operator will need to specify how the currently lined pond will be converted into a <br />groundwater pond. In particular, the operator will need to state how the pond will be "unlined" <br />and specify a time frame in which this will occur. The operator will need to demonstrate <br />compliance in the form of photographs or receipts of work performed on site. <br />The Division will continue the Board item for the possible violation for failure to follow the approved mining and <br />reclamation plan until the July 12-13, 2006 hearing. The time and place of the hearing will remain the same. <br />Once the operator has submitted documentation that the pit has been converted into a groundwater exposed pond, <br />then the enforcement action will be withdrawn. <br />In addition, the operator has not complied with the remaining items noted in the Division's inspection report of <br />January 17, 2006. Please respond to the items noted in the inspection report to avoid possible enforcement <br />actions.
