From: M/_ ~
Doc. Name: ~
Doc. Date (if no
Type-Seq.:
BEFORE THE MINED LAND RECLAMATION BOARD
STATE OF COLORADO
ORDER REGARDING MODIFICATION OF PRIOR ORDER
R
`~° ''~
'~e..
IN THE MATTER OF THE APPLICATION OF AGGREGATE INDUSTRIES WCR, INC.,
FILE NO. M-1999-034
THIS MATTER came before the Mined Land Reclamation Boazd ("Boazd") on
October 29, 2003, in Denver, Colorado for a hearing to consider the request of a party
objector to modify an existing Board Order. The Boazd Order was issued June 25, 2003
concerning the amendment application of Aggregate Industries WCR, Inc., file number M-
1999-034. Larry Oehler appeared on behalf of the Division of Mines and Geology
("Division"). No appearances were made on behalf of the Applicant or any party objectors.
The Board, having considered the parties' presentations and having been otherwise fully
informed of the facts in this matter, hereby enters the following findings of fact, conclusions of
law and order:
On June 25, 2003, the Applicant obtained Board approval for an amendment to an existing
surface sand and gravel pit laiown as the Cooley Reservoir and Fulton Wildlife Area pit
located in Section 16, Township 2 South, Range 67 West, 6`h Principal Meridian, Adams
County, Colorado.
2. Condition no. 2 of the Board's Order required the Applicant to sample Karen Topper's
domestic well, permit no. 2455, for the presence of diisopropylmethylphosphate (DIMP}
prior to and after de-watering of the pit.
In correspondence to the Division dated August 18, 2003, Ms. Topper indicated that the
Board's Order described the wrong well to be tested for DIMP. The correct well to be
tested is Ms. Topper's alluvial irrigation well, permit no. 32883, not her domestic well.
