Cattany <br />Grand Junction, CO 81502 Division Director <br />/ Natural Resource Trustee <br />Re: Pit No 3, Permit No. M-1977-022, Technical Revision No. 2 Preliminary Adequacy Review <br />Dear Mr. Kerr: <br />DMG completed the preliminary adequacy review of your application for Technical Revision No. 2 (TR-02) <br />to Permit No. M-1977-022 for the Pit No. 3 site. The application cannot be approved until the following <br />issues are adequately addressed. Please submit a response to the following issues as soon as possible, <br />but no later than December 30, 2004 so the decision due date set for January 7, 2005 can be met. If you <br />cannot respond by December 30, 2004 please submit a request for extension of the decision date. If your <br />response or an extension request are not received by December 30, 2004 this application may be denied. <br />1. Please show the permit boundary on all maps and ensure -all maps are signed and dated by the <br />qualified preparer. <br />2. Please restrict revision descriptions to structures located within the permit area, unless the description <br />of other structures (outside the permit area) is necessary to support the design of structures within the <br />permit area. <br />3. Please provide engineering specifications and designs for all river restoration construction to be <br />performed within the permit area. and specify what level of <br />4. Please submit the hydrologic data and calculations used to determine the design parameters for the <br />river control structures and specify what size of precipitation event the structures are designed to <br />withstand. <br />5. Please commit to submittal of certified engineering as-built drawings for the river channel restoration <br />within 90 days of the completion of the construction phase of the restoration project. <br />6. Projects slated to receive funding from outside sources sometimes lose funding. In this case, that <br />scenario would leave United Companies responsible for submittal of a substantially increased <br />reclamation bond that covers reclamation of the river channel to the specifications detailed in this <br />technical revision. United Companies may wish to clarify in this revision that the proposed river <br />restoration will take place only if it is fully funded. If funding does not come through for some reason, <br />United Companies will then only be responsible for implementing the current reclamation plan. With <br />this wording in the permit, DMG will only require enough bond to complete reclamation under the <br />current reclamation plan. <br />Office of Office of Colorado <br />
