The application cannot be approved until the following issues are <br />adequately addressed. Please submit a response to the following issues as soon as possible, but no <br />later than January 29, 2003 so the decision due date set for February 6, 2003 can be met. If you <br />cannot respond by January 29, 2003 please submit a written request for extension of the decision <br />date. If your response, or an extension request, are not received by January 29, 2003 this application <br />may be denied. <br />ADEQUACY ISSUES <br />1. Please submit proof that S and R Delta Partners LLLP, The Applehanz's at both addresses <br />listed in the application, the Schleichs and any owners of record of surface easements of <br />permanent man-made structures on or within 200 feet of the proposed amendment area <br />have received a copy of the public notice specified in Rule 1.6.211)le). Include <br />Uncompahgre Valley Water Users Association and any power company that may be <br />associated with the Junction Box if applicable. <br />2. Please submit proof of publication as required by Rule 1.6.2(1)(d). <br />Exhibit C -Mine Plan Mao <br />3. Please ensure all adjacent landowner, easement holder and permanent man-made structure <br />owners are noted on this map. <br />4. It stands to reason that there is powerline connected to the junction box shown on the map, <br />though no powerline is shown. Please correct this discrepancy. <br />5. Please clearly identify the permit boundary on the map. Please be aware that if the edge of <br />the asphalt is delineated as the permit boundary, any disturbance off the edge of the road <br />may be considered as off-site impacts. It is recommended that the permit boundary be <br />wider than the road, though the acreage specified in this application cannot be increased <br />without new notices and starting all applicable timeframes anew. <br />
