Cattany Acting DINSIOrt Director ~/ ~ r~ RE: Spring Creek Pit, Permit No. M-1994-097, Amendment No. 2 Preliminary Adequacy Review Dear Mr. Johnson: DMG has completed the preliminary adequacy review of your application for Amendment No. 2 (AM-02) to Permit No. M-1994-097. The application cannot be approved until the following issues are adequately addressed. Please submit a response to the following issues as soon as possible, but no later than January 29, 2003 so the decision due date set for February 6, 2003 can be met. If you cannot respond by January 29, 2003 please submit a written request for extension of the decision date. If your response, or an extension request, are not received by January 29, 2003 this application may be denied. ADEQUACY ISSUES 1. Please submit proof that S and R Delta Partners LLLP, The Applehanz's at both addresses listed in the application, the Schleichs and any owners of record of surface easements of permanent man-made structures on or within 200 feet of the proposed amendment area have received a copy of the public notice specified in Rule 1.6.211)le). Include Uncompahgre Valley Water Users Association and any power company that may be associated with the Junction Box if applicable. 2. Please submit proof of publication as required by Rule 1.6.2(1)(d). Exhibit C -Mine Plan Mao 3. Please ensure all adjacent landowner, easement holder and permanent man-made structure owners are noted on this map. 4. It stands to reason that there is powerline connected to the junction box shown on the map, though no powerline is shown. Please correct this discrepancy. 5. Please clearly identify the permit boundary on the map. Please be aware that if the edge of the asphalt is delineated as the permit boundary, any disturbance off the edge of the road may be considered as off-site impacts. It is recommended that the permit boundary be wider than the road, though the acreage specified in this application cannot be increased without new notices and starting all applicable timeframes anew.
