There appears to be two problems: <br /> 1. The augmentation plan does not cover water for dust control or water <br /> removed in product. <br /> 2. The decree does not cover leaving a permanent lake on the site. <br /> If the applicant cannot show that they have approval from the Office of the State Engineer <br /> for leaving a permanent lake, the Division of Minerals and Geology must require an <br /> additional financial warranty to provide for backfilling of the exposed ground water area. <br /> Would you please respond to these two items prior to the decision due date of <br /> May 31, 1995. <br /> Sincerely, <br /> iA <br /> Gregg R.
