facilitate the change in the scope of the proposed gravel operations. The <br />Applicant filed Conversion Application CN-001 with the Division in <br />conformance with Construction Materials Rule 1.11. <br />The Board has jurisdiction over the parties and the subject matter of this <br />proceeding pursuant to C.R.S. Section 34-32.5-114. <br />4. The Board appointed a prehearing conference officer who conducted a <br />prehearing conference on June 1, 2004 in Frisco, Colorado. The <br />prehearing conference officer prepared a proposed prehearing order. The <br />parties who appeazed at the prehearing conference included the Applicant <br />and Objectors Rob Neyland and Ann and Tony Hams. Numerous other <br />interested citizens attended the prehearing conference but chose not to <br />become parties to this matter. <br />The Objectors did not appear at the Board hearing. <br />6. The Board approved the proposed prehearing order. <br />7. The issues set forth in the prehearing order are: <br />(A) Has the Applicant identified all the permits, licenses and approvals <br />that will be needed to conduct the proposed mining and <br />reclamation operations including, if necessary, the United States <br />Army Corps of Engineers, the Air Quality Control Division and <br />the Summit County Commissioners? (Construction Materials Rule <br />6.4.13.) <br />(B) Has the Applicant adequately considered potential impacts to the <br />prevailing hydrologic balance, specifically potential contamination <br />
