ISSUES RAISED BY OBJECTING PARTIES DURING THE PUBLIC COMMENT <br />PERIOD: <br />Issues raised by objecting parties aze listed below, along with the names of the objectors. The Division's <br />response to objection issues follows. Issues are listed under the section of the Construction Materials Rules <br />and Regulations to which they pertain. Issues that the Division believes are not within the jurisdiction of <br />the Division or Board aze listed afterwards. <br />A. ISSUES WITHIN THE JURISDICTION OF THE DIVISION AND BOARD <br />1. Rule 6.4.7 Exhibit G -Water Information <br />Mr. Chappell, an adjoining landowner, raised the concern of how the proposed operation may <br />impact groundwater at and around the site, as well as a past issue regazding the loss of his ability to <br />regulate irrigation water from his headgate on the Ouray Ditch. <br />DRMS Response <br />The groundwater question raised above is related to Rule 6.4.7 (1) of the Construction Materials <br />Rules and Regulations, which requires the applicant to state expectations of the operation's direct <br />effects to surface or groundwater systems, and to Rule 3.1.6 (1), which requires that disturbances to <br />the prevailing hydrologic balance of the affected land and of the surrounding area and to the quantity <br />and quality of water in surface and groundwater systems both during and after the mining operation <br />and during reclamation shall be minimized. <br />The Applicant has submitted a mining plan for the site that specifically states that groundwater will <br />be exposed. The Applicant plans to mine to a depth of 30 feet below the present pit floor, and the <br />water table is known to exist at about two feet below the present pit floor. The application <br />specifically states, however, that no pumping to dewater the pit will occur, since such pumping <br />could potentially draw down the water table, and/or neazby wells. Pitrun will be extracted by use of <br />a tracked excavator. <br />Because the proposed operation does anticipate groundwater, and groundwater will be consumed by <br />evaporation, dust control, in the mined product, processing, and reclamation, the DWR has informed <br />the Applicant that a gravel pit or other type of well permit is required.
