Dear Ms. Larsen:
Your letter dated January 13, 2005, requesting renewal of the above referenced substitute
water supply plan to cover depletions caused by an existing gravel mining operation has been
reviewed. The required fee of $217 for the renewal of this substitute water supply plan has been
submitted. The original plan was approved on July 27, 1998 and it was most recently renewed on
June 21, 2004. An augmentation plan for the site was filed with the Division 1 Water Courtin Case
No. 2000CW142. Loveland Ready-Mix Concrete, Inc. has also obtained storage water rights in
Case No. 98CW431 for storage in two of the pits within the site, identified as pit 16 and 17. Mining of
pit 16 has been completed and it has been lined and mining of pit 17 has been completed and it is
currently being lined. Dewatering of pit 17 will continue until the lining process is complete.
Loveland Ready-Mix Concrete, Inc. has also completed mining at Pit 19 and the pit has been
completely backfilled. Pit 18 will be mined and dewatered over the next several years.
The anticipated net depletion for this plan is 60.18 acre-feet per year, which includes
evaporation from up to 22.89 acres of water surface exposed after December 31, 1980. According
to the information submitted, 82.47 acres of water surface, out of a total of 105.36 acres to be
exposed at the site, was exposed within the reclamation permit boundary prior to January 1, 1981.
You have provided a monthly breakdown of the depletions for this year of operations from the
beginning of March 2005 through the end of February 2006. The depletions total 44.64 acre-feet of
net evaporative loss, 11.23 acre-feet of water used to batch concrete (which represents production
of 1'22,000 cubic yards of concrete), 0.48 acre-feet of water lost with mined product (which
represents 16,488 tons of mined product), and 3.83 acre-feet of water used for dust control.
Phreatophyte credits of 5.29 acre-feet per year have been applied to this plan.
The proposed sources of replacement water for this pit are 42 Bames Ditch inches diverted
from the Big Thompson River and previously used for irrigation of the mined property and 78 units of
Colorado-Big Thompson Project water owned by Loveland Ready Mix. The Bames Ditch inches,
provide a dry year historic consumptive use credit of 39.36 acre-feet, based on a field efficiency of
60% and ditch loss of 5%. A dry-up covenant has been provided for the 42 Bames Ditch inches
claimed under this plan. The acreage that is referenced by the dry-up covenant will need to be
verified by the Division Engineer prior to any renewal of this plan. Replacements during May
through Octoberwill be made by diverting the Bames Ditch water, measuring it, and then returning it
to the Big Thompson River. Adequate flow measuring devices, satisfactory to the Water
Commissioner, must be installed for the administration of this replacement water from the Bames
