The applicant shall file with the Department of Planning and Development an annual <br />mining operation and reclamation activities report that addresses compliance with <br />the conditions of this Special Use Permit. Said report shall be submitted by the first <br />day of the anniversary month of the approval date of this Special Use Permit. <br />5. The applicant shall develop, operate, and manage the mining-related activity <br />according to the rules, regulations, plans and permits administered by the applicable <br />federal, state. and local agencies. Any violation of a rule, regulation, permit, or plan <br />may result in the scheduling of a Show Cause Hearing to consider revocation of <br />Special Use Permit No. 2002-005. <br />6. The applicant shall conduct the gravel operation in such a manner as to not damage <br />the Bessemer Ditch or the natural gas transmission line. With respect to the gas <br />transmission line, the extraction shall be done in accordance with the terms and <br />conditions set forth in the letter from the Colorado Interstate Gas Company to Pueblo <br />County, dated December 16, 1986 (Exhibit Sa of Staffs Review dated June 11, <br />2002). <br />7. The haul route for this operation shall be along Cortner Road east to South Road, <br />east to Lane 36, then north to the State Highway. <br />8. The applicant shall continue to apply a dust palliative, as determined by the County <br />Public Works Department, to Cortner Road, from the pit entrance east to South <br />Road. This dust palliative will be applied only when the applicant is hauling on the <br />above-described roadway section. <br />9. The applicant shall repair in good workmanlike manner any damage caused by their <br />operation, to those sections of Cortner Road, South Road and 36th Lane used as a <br />haul route, as determined by the County Public Works Department. <br />10. Repairs shall include, but not be limited to, patching potholes and restoring the road <br />to a condition as good as, or better than existed prior to commencement of the <br />applicant's operations under the Special Use Permit. <br />11. The applicant shalt be responsible for all traffic control during roadway repairs <br />required in Condition No. 10. Prior to commencing any roadway repairs, the <br />applicant shall submit to Public Works a traffic control plan, which has been prepared <br />by a traffic control supervisor certified by the American Traffic Safety Services <br />Association, Inc. No roadway repairs will be started prior to approval of the traffic <br />control plan by Public Works. <br />12. Prior to commencing any roadwork repairs, the applicant shall show evidence of a <br />valid and in-force Bodily Injury and Property Damage Liability Insurance Policy, with <br />minimum limits of six hundred thousand dollars ($600,000.00) per occurrence and <br />1.2 million dollars ($1,200,000.00) general aggregate. Such policy shall be for the <br />protection of the County from all suits, actions, or claims of any type for injuries or <br />damages allegedly sustained by any person or property on the premises or as a <br />
