Sorenson
Re: File No. M-81-302
Deepe Farm Pit TR006
Dear Mr. Sorenson
As you know, the University of Colorado is the owner of the property covered by the above-
referenced reclamation permit. TR006 has been submitted in order to enhance the berm to
increase the amount of freeboard above the water-surface level of the regulatory 100-year
base flood to provide an additional factor of satiety for downstream residents.
The University will be seeking recognition (often referred to as certification) of the berm.
One of FEMA's requirements for recognition under 44 C.F.R S 65.10 (d) is the official
adoption of a maintenance plan by a federal or state agency that assumes ultimate
responsibility for maintenance. The University of Colorado, as owner of the berm or levee,
will assume ultimate responsibility for maintenance consistent with FEMA regulations.
The University's formal written maintenance plan for the berm is in the process of being
prepared. It will document the formal procedures to maintain the stability, height and overall
integrity of the berm and its associated structures and systems. The plan will necessarily
comply with all requirements of FEMA and other applicable regulations for maintenance and
operation of the berm.
