The Division of Minerals and Geology received objections to the 112 Mining and Reclamation Pemlit Application for the S&H
Mine, Amendment Application Ol (AM-Ol) File No. M-2000-158. In order to have this item heazd at the August 24-25, 2004
Mined Land Reclamation Boazd (MLRB) Hearing, the following schedule will need to be met.
August 2, 2004 Platte Sand & Gravel will respond to all items in the Division's adequacy letters dated July 8, 2004
and July 19, 2004 to the satisfaction of the Division (including comments from the objectors).
August 3, 2004 All parties (including objectors) will submit a list of witnesses and exhibits and provide copies of
exhibits (unless already included in the amendment application file) to all parties including 15 copies
to the MLRB.
August 13, 2004 DMG will render its recommendation to the MLRB; and parties will receive copies.
August 24-25, 2004 MLRB Hearing.
Under the Constmction Material Rules and Regulations, apre-hearing conference and a formal Boazd hearing will be held as
follows;
Pre-hearing Conference (Rule 2.7) The Pre-Hearing Conference will be presided over by the Pre-Hearing Conference
Officer. The Pre-hearing Conference Officer is appointed by the Mined Land Reclamation Boazd. The purpose of the Pre-
Hearing Conference is to draft a proposed hearing order that lists issues the Board should consider, lists the witnesses and
evidence to be presented by parties }fists Ehe parties that wig participate,-and lists-the amolmt oftime afferded each party. The
Pre-hearing meeting will be held at the Division of Minerals and Geology, 1313 Sherman St., Rm. 215, Denver, Colorado on
August Z, 2004 at 10:00 a.m. Please note that the proposed order will not be final unless and until the Boazd adopts it at the
formal hearing. The parties will have an opportunity to object to the proposed hearing order at the formal hearing.
Formal Board Hearing (Rule 2.8) The Boazd will conduct the S & H Mine AM-Ol hearing according to the provisions of the
hearing order if adopted, the Administrative Procedures Act, Section 24-0-105, Colorado Revised Statutes (C.R.S.), and the
Colorado Code of Regulations, 2 CCR 407-4, Section 2.8. The Formal Public Hearing will be held during the August 24-25,
2004 Boazd meeting. The hearing will be held in Room 318 of 1313 Sherman Street, Denver, Colorado, beginning at 10:00
a.m. on August 24, 2004 and 9:00 a.m. on August 25, 2004 or as soon thereafter as the matter can be considered.
