I have attached a revised Table RV2 to reflect the new seed <br />mix. <br />I want to-make it clear that I do not agree that the Urban <br />Drainage and Flood Control District (UDFCD) has jurisdiction to <br />dictate the seed mix to be used at this mine. Suburban Sand and <br />Gravel Co. is the permit holder and has posted a bond to assure the <br />reclamation can be completed as proposed. if UDFCD would like to <br />take responsibility for making the grass grow I am sure something can <br />be arranged so they can guarantee it will grow. Until then Suburban <br />and Gravel Co. will decide what grass seed mix will be used. I also <br />contend that there is a section of the law that states that no other <br />government agency can require reclamation standards different than <br />those established by the Mined Land Reclamation Board (CRS 34-32.4- <br />104(3)) that applies to UDFCD. <br />If you have any questions please call me at(303) 423-7297. <br />Respectfully submitted, <br />~~~e <br />Stevan L.
