<br />Battle Mountain Gold <br />Notice of Probable Violation <br />Abatement Requirements <br />(Permit No: M-88-112) <br />As abatement for the Notice of Probable Violation issued to Battle Mountain <br />Gold (BMG) on March 31, 1992, the Division imposes the following performance <br />requirements. <br />(1) Immediate Increased Tailings Area Security: <br />BMG shall develop and implement a Tailings Area Security program, in <br />order to safe guard the health and safety of the general public and <br />wildlife. The plan shall be submitted to the Division as soon as <br />possible for review and approval. In the interim, BMG shall implement <br />whatever increased surveillance it deems appropriate to control the site. <br />(2) Immediate Assessment of Environmental Impact: <br />BMG shall review all available environmental monitoring data collected to <br />date, including its approved ground and surface water monitoring sites, <br />air quality monitoring sites, the tailings pile leak detection system, <br />the processing plant circuit, and any other applicable monitoriing <br />facilities. A report summarizing its initial findings shall be submitted <br />to the Division by Friday, April 10th. <br />(3) Accelerated Frequency of Environmental Monitoring: <br />The frequency of monitoring of the environmental monitoring facilities <br />referenced in item (2) above shall be accelerated to bi-weekly, <br />commencing immediately and continuing until relaxation is approved by the <br />Division. The initial samples shall be submitted to an EPA certified <br />laboratory for "rush" analysis. Subsequent samples may be processed <br />normally. <br />The results of each set of sample analyses, covered with an appropriate <br />brief summary letter report, shall be submitted to the Division within <br />three days following completion of the analyses by the laboratory. <br />(4) Tailings Cyanide Detoxification: <br />BMG shall develop and submit a plan for cyanide detoxification of the <br />entire slurry and liquid contents of the tailings impoundment ds soon as <br />possible for review and approval by the Division. This plan shall be <br />submitted as a technical revision application. This application shall <br />include a schedule for implementation. Following approval of this <br />technical revision, BMG shall implement the treatment method in <br />accordance with the plan. Appropriate frequency and distribution of <br />monitoring of the tailings and plant circuit shall be proposed within <br />thew application and subsequently conducted to verify the progress and <br />success of the remedial treatment. Monitoring results, covered by an <br />appropriate cover letter report shall be submitted to the Division weekly <br />during the detoxification program. <br />
