EXHIBIT N
TO
SANDCO AMENDMENT TO RECLAMATION PERMIT
SOURCE OF LEGAL RIGHT TO ENTER
The Applicant has filed an application with the Army Corps of Engineers on March 3, 2004 for a
river crossing in what is referred to as the Dalton Pit, which by this application is also to be known
as the Sandco Pit. The Application with the Army Corps of Engineers has been accepted and sent
out for public notice, which is to be made on Apri123, 2004.
The Application is for a right to cross the Animas River between Sandco's processing plant area and
the proposed pit area which is illustrated on Exhibit A to this application. Access to the processing
plant is off of La Plata County Road 252.
The Applicant's shareholders are the owners of Dillon Ranches LLLP who leases the property for
both the processing plant and the proposed pit area. This property is on both sides of the Animas
River. The only legal right of entry for access from the pit area to the processing area is obtaining
permission for the river crossing from the Army Corps of Engineers.
Assuming the river crossing permit will be granted by the Anny Corps of Engineers, the Applicant
will supplement this application with a copy of the permit upon receipt.
Dillon Ranches LLLP has granted and does grant to Sandco, Inc., the Applicant, the right to enter
the lands described on Exhibit A to conduct mining operations and reclamation.
DILLQN RANC S LLLP ~~~~
Bx~'- ~ c ~~/ `L
David D.
