The issuance of this permit does not assure the applicant that no injury wilt occur to another vested water right or preclude another owner of a vested water right from seeking relief in a civil ccurt action. 2} The construction of this gravel pit pond shall be in compliance with [he Water Well Construction Rules 2 CCR 402-2, unless approval of a variance has been granted by the State Board of Examiners of Water WeII Construction and Pump Installation Contractors in accordance with Rule 18. 3) Approved pursuant to CRS 37-90-t37 (2) and (t i j for the construction and operation of a gravel pit pond exposing and diverting ground water tributary to the Animas River of a point where water is available for appropriation. This gravel pit is known as the Sandco Inc. pit, Division of Minerals and Geology permit no. M-1987-064. 4) The approval of this permit does not grant a water right This gravel pit pond is subject to administration by me Division Engineer in accordance with applicable decrees, statutes, rules and regulations. 5) The maximum pumping rate shall not exceed 350 GPM both during cravef mining operaiiorts and after grave( m"ruing operations are completed. B} The average annual amount of ground water to be appropriated shat) not exceed 123 acre-feet during gravel mining operations, and 101.5 acre-feet after gravel mining operations are completed. The total sudace area of the proposed ground water pond is limited to 45 2cres. 7) t7uring gravel mining operations the use of ground water is limited to ircigation. dust suppressron, and evaporatfon. Upon completion of gravel mining operations the use of ground water is limited to irrigation and evaporation. No other use of water is allowed unless a permit therefor is approved. Water from this well shall nut be used for human consumption without separate approval from the Board of Examiners of W afar Well Construction and Pump tnsfallalion Contractors. ej The owner shaft mark the gravel pit pond in a conspicuous place with welt permit number(s) and court case number(s) as appropriate.
