Cattany <br />Division Director <br />Natural Resource Trustee <br />The Division of Reclamation, Mining and Safety received vour Technical Revision ADDlication (TR-Ol) <br />to the Arkins Park Quarry, Permit No. M-1985-212. <br />Upon further review of the application submitted by Arkins Pazk Stone Company, the Division believes <br />the revised reclamation plan should be an Amendment to the Arkins Park Quarries rather than a <br />Technical Revision. The definition of Amendment as described in the Construction Material Rules and <br />Regulations "means a change in the permit or an application which increases the acreage of the affected <br />land, or which has a significant effect upon the approved or proposed Reclamation Plan." <br />The proposed new road location crosses over a gulch that was not included in the original area to be <br />affected. The original permit maps approved by the Division did not designate this azea as affected land. <br />A new road location over newly affected land should be subject to the public review comment period <br />that is required under amendment applications since it will disturb an azea not previously approved in <br />the original mine plan or subsequent changes to the plan. <br />Please resubmit this revision as a Permit Amendment Application. Applications for Amendments are <br />reviewed by the Division in the same manner as applications for new permits and require a fee of <br />$2,696.00. Please instruct the Division if you would like the $188.00 Technical Revision application fee <br />returned, or applied to the cost of the Permit Amendment. In doing so, Arkins Pazk Stone Corporation <br />will need to formally withdraw the request for the Technical Revision. The withdraw notice must be <br />received by the Division prior to the Division's decision due date of August 1, 2007.
