Reclamation Permit to the Applicant. On November 23, 2004, the Applicant submitted a <br />conversion application to the Division seeking the conversion of the Section 110 <br />Reclamation Permit into a Section 112 Reclamation Permit pursuant to Construction <br />Materials Rule 1.11. The conversion application sought to increase the permitted area <br />from 9.9 acres to 341 acres. The Division approved the conversion application, but <br />because a financial warranty for the permit conversion application was not submitted in a <br />timely manner, the Applicat was required to republish notice of the conversion <br />application in a local newspaper. Potential party objectors then filed timely objection <br />letters. <br />The Applicant, the Division and potential party objectors now seek a temporary stay of the <br />proceedings, as set forth in the Motion. Based on the Division recommendation, it is <br />appropriate for the Board to grant the Division's request to continue this matter until the <br />December 2006 Board meeting (for a ruling on all outstanding motions) and to adopt the <br />proposed schedule leading to a January Board hearing as set forth in attached Exhibit A. <br />ORDER <br />Based on the foregoing findings of fact and conclusions of law, the Boazd hereby grants the <br />Motion to Continue Hearing and Stay Proceedings and hereby adopts the proposed schedule <br />as set forth in attached Exhibit A. <br />King Mountain Gravel, LLC <br />M-1978-314 <br />
