Inc. for Western <br /> Mobile-Boulder. This analysis was submitted to the Division of Minerals and Geology(DMG)to satisfy a requirement <br /> listed in the DMG's report on a February 18, 1999 site inspection. You were previously sent a copy of the inspection report. <br /> The piping analysis has been reviewed by the DMG staff in consultation with the staff of the Colorado Water Conservation <br /> Board. As a result of this review, DMG has determined that levee failure via a piping mechanism is highly unlikely to occur <br /> during the design, one-percent annual chance flood on South Boulder Creek. DMG has further determined that Western <br /> Mobile-Boulder has adequately addressed the piping concern identified during the February 18, 1999 inspection of the <br /> Deepe Farm Pa and documented in the inspection report. <br /> The regulations of the Colorado Mined Land Reclamation Board (Rules 1.4.7 and 1.9.2)provide that the DMG's <br /> determination in this matter may be appealed to the Board if the appeal is filed within sixty(60)days, i.e., no later than <br /> August 10, 1999. Any request for administrative appeal must specify the permit number for the operation in question <br /> (Deepe Farm Pit: Permit No. M-81-302)and must list all factual and legal questions the appellant wishes to have the Board <br /> decide. <br /> If you have any questions, please contact myself or Gregg Squire. <br /> Sincerely, <br /> Allen C.
