The <br />total length of fencing necessary to prevent access to the highwall is <br />approximately 1,160 feet, the location of which is shown on the attached map. <br />The fence will be installed on or before June 30, 2006, to allow the Lyons Plant <br />management time to obtain funding approval through the corporate budgeting <br />process. Cemex will submit a new bond to cover the cost of fence installation <br />(estimated cost $37,000 -actual bond amount subject to approval by the <br />Division) within 60 days of approval of this Technical Revision. <br />We appreciate the Division's research regarding the deed restriction issue, and <br />acknowledge that a deed restriction is recommended, but not required, by the <br />Division. Cemex is currently in compliance with the 1984 Board stipulation <br />regarding recreational use of A-Pit, as the site is not available for recreational <br />use. A-Pit is still an active part of the permit site, as water from the reservoir is <br />used for cement plant operations. Cemex hereby commits to preventing <br />recreational use of A-Pit, via signage and property boundary fencing, until such <br />time the property is released from reclamation bond requirements. <br />2. Leiding Pond Hiqhwall -Cemex will reclaim Leiding Pond so that all slopes are <br />no steeper than 2H:1 V, except from 5 feet above to 10 feet below the expected <br />water line where slopes shall be no steeper than 3H:1 V. Cemex will complete <br />this reclamation prior to June 30, 2005. <br />A revised, signed reclamation plan map is enclosed. We look forward to your approval <br />of this Technica( Revision. <br />
