DICOLA <br />County Attorney <br />C n,.~e rl-~~ertfs e~ `t-L~-e <br />ff{'Vl C2~ C`~(' ~~ Ca~~`a.2 <br />Re: Henderson Mine and Mill Amendment'AM-04: Mining and Reclamation Permi M-77-342 V <br />Dear Colorado Mined Land Reclamation Board: <br />Grand County is in receipt of the Climax Molybdenum Company, a Subsidiary of Phelps <br />Dodge Corporation (the "Company"), Henderson Mine and Mill application for an Amendment to <br />its approved Reclamation Permit dated January 15, 2002, with the Colorado Mined Land <br />Reclamation Board. The proposed amendment includes the following: (1) Deletion of Area 23; <br />(2) Change in General Post-Mining Land Use; (3) Change in Post-Mining Land Use at the Mine <br />Site -Building Retention; and (4) Change in Reclamation Plan and Post-Mining Land Use at the <br />Tailings Impoundment, which includes a conceptual alternative, alternative conceptual plan and <br />rationale for the new alternative. Lastly, two (2) technical revisions, TR-04 and TR-12, remain <br />under review by the Colorado Division of Minerals and Geology. TR-12 is of significant <br />importance to Grand County as it proposes the use of an existing .17 acre landfill and <br />development of a new 7.5 acre landfill as part of the Reclamation Plan. <br />On Wednesday, March 5, 2003, Grand County met with the Company to discuss the <br />proposed amendments. Also, in attendance were the Northwest Colorado Council of <br />Government, Colorado Division of Wildlife, U.S. Forest Service, Williams Peak Ranch and <br />Arthur Bruchez. This attendance reflects a strong community interest and also the importance of <br />the reclamation aL the Henderson Mine and Mill and the proposed amendments to local, state and <br />federal agencies, ranchers and the general public. The meeting was conducted to initiate a <br />dialogue between the Company and Grand County so that issues and concerns could be openly <br />P.O.
