The
proposed mine is known as the ULA PIT, and is located in Custer County at or near Section 16,
Township 225, Range 73W. The proposed mine (gravel pit) would expand to 40 acres an existing
] 0 acre mine, located on land leased from the State of Colorado and surrounded by land used for
residences, grazing, haying and recreational purposes. The proposed date of commencement of
operations is summer 2004. The proposed date of completion is winter 2040.
The parties to this objection and petition for a hearing will be adversely affected by this operation
for the following reasons: 1) the value of their land will to drop with a quadrupling in size and noise
of this nearby gravel operation; 2) their businesses (including horse raising, boarding and riding,
cattle grazing and haying and tourism} will be adversely affected due to noisy and dangerous truck
traffic increases and road dust (roads in this area are not paved and there is a nearby Wilderness
Area, designated Class 1 under the federal Clean Air Act); 3) for those parties living nearby, the
peace, quiet and safety will be compromised; and, 4) for every party, this development will
seriously reduce water supply and threaten water quality.
' First publication of the notice of this filing was received via certified mail by Shirley Lloyd, among others,
on June 17, 2004.
