"1V1~1~Vt <br />Apri122, 2004 <br />Mr. Berhan Keffelew <br />Division of Minerals and Geology <br />1313 Sherman Street <br />Denver, CO 80203 <br />~V <br />J•R ENGINEERING <br />A Westrian Company <br />RE: Response to Comments -Mining and Reclamation Permit Amendment Application for <br />Pit 29, Permit No M-80-183, Adams County Colorado <br />Dear Mr. Keffelew: <br />We have prepared the following to respond to the review comment by the Division of Minerals <br />and Geology. <br />Division of Minerals and Geology Comments <br />Exhibit C, Pre-mining and Mining Plan Maps - We have shown the location, type of structure <br />and owner of all significant structures within two hundred feet of the affected land in compliance <br />with Rule 6.4.3(9). <br />Exhibit D, Mining Plan -The dewatering plan is to pump water from the active pit to the <br />inactive pit, therefore no water is planned for discharge from the site and a NPDES permit is not <br />required. The operator will maintain sufficient stormwater storage in both the active and water <br />storage pits at all times such that the pond's capacity will not be exceeded. <br />Exhibit E, Reclamation Plan -The third reservoir is included as part of this amendment. The <br />third reservoir is shown on the Index Map as Parcel D. This area will either be included with <br />Parcel A and C as Reservoir R or split by a slurry wall and embankment into Reservoirs II and <br />III. <br />Silver Peaks Metropolitan District #1 has adequate water rights for all three reservoirs. <br />All topsoil stockpiles will be seeded in accordance with the requirement of the NRCS. <br />Attached please find the Noxious Weed Management Plan. <br />Exhibit G, Water information -The mine property and affected area aze outside the 100-year <br />floodplain for the South Platte River as shown on Figure G-2.
