SUPPLEMENT TO EXHIBIT S <br />Red <br />SfP <br />~ ~~pp4 <br />QNSi~~of ~o F.BItl <br />ne~is ~~~o9Y <br />Pursuant to Bob Oswald's letter of August 13, 2004 regarding Exhibit S to the application, each <br />fence within 200 feet of the affected azea is owned by the applicant except for the following <br />fences which are boundary fences: <br />Mazk R. McGarry, III <br />7105 County Road 250 <br />Durango, Colorado 81301 <br />Dina Mazie O'Brien <br />5836 County Road 250 <br />Durango, Colorado 81301 <br />The boundary fences aze controlled under the Colorado Fence Law, C.R.S. §35-46-1Ol.et.seq. <br />The boundary fence with McGarry is five wire barbed wire fence consisting of treated posts set <br />every 15 feet and steel stays centered between each of the treated posts. The fence between the <br />Applicant, Dillon Ranches LLC ("Applicant" or "Sandco") and O'Brien is exactly the same <br />except the fence wire is smooth. <br />It is not anticipated that either fence will be damaged by use of this permit. However, in the <br />event the Applicant damages the fence, it will repair the same back to its former condition as <br />required by C.R.S. §35-46-101, et.seq. <br />There are no ditches located within 200 feet of the affected area except for those owned by the <br />Applicant, which ditches do not affect any other property owner. <br />
