:i
;~
STATE OF COLORADO
Memo
TO: Bruce Smith
Water Commissioner, Water District 11
CC: Bill Tyner, Division 2 Office
Carl B. Mount, DMG
FROM: Don West
DATE: December 21, 2005
SUBIECT: GOLD BASIN MINE (DMG NO. M-1992-045)
Attached you will find the DWR recommendation to Division of Minerals and
Geology that no favorable action be taken to a DMG amendment request for the
Gold Basin Mine until the applicant submits a water supply report. After reviewing
this file, I also suspect that the applicant may be diverting water out of priority and
may need a substitute water supply plan or a plan for augmentation to operate.
Papers provided by DMG consist of a water right in case no. 86CW79 (See
attached.) You may need to perform a site visit and review the decree to see if the
applicant is operating within the limits of the decree. Since the decree is junior to
all other decrees prior to 1986, it seems unlikely that the applicant can operate in
priority under case no. 86CW79. It may be necessary to initiate enforcement
actions through the Division Office if the applicant is operating out of priority.
Please provide a copy of any field inspection reports to Carl Mount at the DMG for
their files. Feel free to contact me if I can be of any further assistance.
OFFICE OF TILE STATE ENGINEER DON WEST
Division of Water Resources Water Resources Engineer
Department of Natural Resources Telephone: 303/866-3581
1313 Sherman Street, Room 818 Fax: 303/866-3589
Denver, CO 80203 E-mail: don.west@state.co.us
