(BMRI), SAN LUIS MINE, <br />TAILINGS 8l03ANRliENT CONSTRUCTION THIRD PARTY MONITORING <br />Dear Jim: <br />we are working diligently to prepare a proposed contract <br />for the third party oversight of the San Luis Mine tailings <br />disposal area, Phase 2, Raise I construction. However, as you <br />know time is of the essence and review of the contract by all <br />parties may not be completed for another week or so. We would <br />like to notify the Division that we are willing to authorize <br />work to start on Tasks i and 2 as outlined in your letter dated <br />October 12, 1993 without a contract. We believe that the <br />review of documents and perhaps an initial field visit can <br />occur over the next week while we are finalizing the contract. <br />BMRI is willing to assume the limited risk associated with <br />starting work without finalization of the contract and will <br />agree to pay time and materials for this work as invoiced from <br />Water Waste and Land. <br />Please let me know if this approach is acceptable to the <br />Division and if you or Water Waste and Land need any additional <br />information from SMRI to begin the work. <br />Sincerely, <br />G~~i (i• s~~~ <br />Anne C.
