Response: CC&V concurs with the OMLR's clarification that some temporary seasonal ponding may occur in
the.surface mine areas. Such seasonal ponding will ba short term snd dependent on the amount of
precipitation received. In making the above referenced statement, CC&V was referring to the lack of
evidence. that the mines could become flooded in a manner that could create either an intermittent or
perennial water impoundment of any size.
F. Thefnal topography shown on brewing E-1 for the East Cresson mine bacl~ll is conceptual. In order
td properly evaluate the financial warrany, the Division needs to know the actual configuration and the
,dot/FC'e'bf the material to achieve the desired past-mining configuration. Please provide the appropriate
map.oi+:maps in accordance with the Rule 6.4.6(a) and (h). Also refer to 6.4.4(L)(i)

G. Under the Phase IV VLF Reclamation, the operator stares "ore which lies beneath the liner for the
Phase IVPSSA, will be accessible by sprinklers placed om top of the VLF. Upon completion of rrnstng
of the-VLF, holes will be drilled through the Phase 1'YPSSA liner. Water and hydrogen peroxide (HsO~
will be~inrroduced to the underlying ore through these holes. Prior to puncturing holes through the
liner,.Ehe operator has to obtain approval from the Division. The upper leachate solution from the ore
has to rneet all applicable water standards and 0.2 mgll WAD CNsta»dard set 6y the Division.

Response: ~ ~GC,BcV will obtain OMLR approval prior to puncturing the phase N PSSA liner. However, CC&V
would`1ike to point out that the Phase III liner system lies beneath the azea in question and, once the
Phas~);V PS5A liner is punctured, detoxified water will continue to be contained within the VLF and
recirculated for ongoing dctaxiFication.

The statement that "the upper leachate solution from the ore has to meet all applicable water standards
and 0.2 mgll 'WAD CN' does not appear to recognize that detoxified solutions from above the
punchired Phase IV PSSA liner will continue to be contained within the VLF system.
