As with Amendment No. 7, chain link fence was selected because it is more
eiipensive to install than earthen berms or safety benches. CC&V proposes to retain the option approved
under Amendment No. 7 of installing earthen features.
E, ~n=Fdg"e~108 the operator states, "as demonstrated to date by CC&V operations. there is no evidence
that `tiler will be impounded in the mine areas upon completion of mining. The Divisio» will agree,
water"~t~ill not be impounded for a longpertod within the pit areas. However, there will always be
tempdrary ponding after a precipitation event as evidenced in the Iron Clad and Globe Hill pits prior to
them being bac~lled. Please clarify your Statement.
Y
Response: CC&V concurs with the OMLR's clarification that some temporary seasonal ponding may occur in
the.surface mine areas. Such seasonal ponding will ba short term snd dependent on the amount of
precipitation received. In making the above referenced statement, CC&V was referring to the lack of
evidence. that the mines could become flooded in a manner that could create either an intermittent or
perennial water impoundment of any size.
F. Thefnal topography shown on brewing E-1 for the East Cresson mine bacl~ll is conceptual. In order
td properly evaluate the financial warrany, the Division needs to know the actual configuration and the
,dot/FC'e'bf the material to achieve the desired past-mining configuration. Please provide the appropriate
map.oi+:maps in accordance with the Rule 6.4.6(a) and (h). The financial warranty is
consar+iative, that is it is overestimated, because it addresses the grading and revegetation o£the lazgest
disturbed area that would be involved.
~;
G. Under the Phase IV VLF Reclamation, the operator stares "ore which lies beneath the liner for the
Phase IVPSSA, will be accessible by sprinklers placed om top of the VLF.
