...
;,
,, .
b ;.
'' {} Te
data can be collected and analyzed within that lima frame. If a longer time frame is required, CC&V
•r~ll notify the OMLR and provide a schedule for submittal of the informafion. In this context, it is .
noted~that the geatechnica] stability of mine highwalls of concern relates to (1) instability that could
adv'ers ely affect off-site areas for which disturbance was not approved and (2) instability of highwalls
that will remain after mining.
V. 6.aS
A. On pagpp I t)Z the operator states, "CC&V also envisions that it may become appropriate to adopt
landuse plans developed by the current Joint Planning Effort (Cripple Creek, Victor, and teller County
with C~& Vparticipation). This planning ejj'ort may result in support for landuses that may dyer front
those, cyrrrently planned and achieved. Under AM-07, the OMLR/MLRB approved CC&V's request tv
aflowsuch changes m the reclamation plan to be considered as !ethnical revisions to the permit.
1. '~}Indeed the Division has allowed some items to be sabmitted as Technical Revisions to facilitate
„approval. Flowever, the operator or operators were required to waive his or her right to a
,•decision wtthln thtrry (3tl) days and publish in the local newspaper as required under
;Amendment applications. If an objection is received on or before the end of the comment
~+ • . ;'':period, the Technical revision is processed as an amendment, If this is the understanding
~•~ 1'CC&V has, changes can be submitted as Technical Revisions. An Amendment is defned in the
-. ;IHard Rock/Meta! Mining Rules and Regulations as a "change in permit or an appliCalion
which increases.lhe acreage oj'the a~eeted land or which has a signif::cant d{Iect upon the
approved or proposed reclamation or Environmental Protection Plan. "
Response; CC&V agrees to waiving a decision within 30 days, when justified, and publishing a notice in the
local newspaper for changes to the reclamation plan necessitated by changes to the'land use plans For
the.••mine area The OMLR will recall that the land use provision cited above was added to accommodate
the County land use planning process where other land uses may be identified. CCBcV has
acknowledged that it will work expeditiously with the County to evaluate other land use plans for
CC&V:lands. A proposed post-mining land use should not be a "significant" change. As such, CC&V
believes this should be decided on a case-bY-case basis by the OMLR.
B. Growth Medium
As mentioned.tn J;xhibit D, all available growth medium Has to be salvaged. The Division will have no objection
if the opertitor;;emporarily stockpiles these growth mediums to unapproved locations unfit such time, the
operator moves them into the permanent locations.
Response:. As;previously mentioned, the criteria for topsoil removal was taken directly from the approved
Amendment No, 7 language (see Amendment No. 7 pages 430 and 5-36 of the accompanying tent in
Volume I). The depth of recovery is a function of the nature of the soil, weathered bedrock, and slope
angle; as well as the capahiIities of the dozers and other mechanized sail salvage equipment. In
addition, as correctly pointed out by the OMLR in Section V.B.1 of these cotntnents, CC&V is
15rojeoLing an excess of about 368,900 cubic yards of gmwth medium which indicates that an adequate
quantity, will be available for reclamation. As a result, CC&V believes that the criteria employed for
gigwthmedium salvage is the moat appropriate for the equipment being used and she nature of the soils
iii the. arse, CC&V appreciates the ability to develop temporary soil stockpiles during operations.
Growth medium that can be easily and efficiently removed with available mining equipment will be
salvaged.
,.
