I regret not taking the opportunity earlier in the <br />process to explain the amendment in more detail to your staff. <br />I'd like to take the time to address some of the issues that the County has raised regarding <br />the amendment. Particularly, I'd like to respond to the County's draft letter to the Mined <br />Land Reclamation Board that I was provided at our meeting. <br />It is true that Amendment AM-04 is driven, in part, by Henderson's desire to reduce the <br />financial warranty for the Henderson Mine and Mill. When the Division of Minerals and <br />Geology recalculated Henderson's financial warranty late last yeaz, we felt that it grossly <br />overestimated the reclamation costs for Henderson. However, most of our disagreement <br />with the Division is not related to the reclamation activities themselves, but is focused at <br />the unit costs used by the Division and has been addressed outside this amendment. The <br />amendment is also driven by the realization, when we reviewed the financial warranty <br />package, that some of the reclamation activities in Henderson's permit no longer reflect <br />Henderson's own, internal plans for reclamation either because of changes to the mine <br />plan, newer technologies or due to community desires for post-mining land use. <br />LOST CREEK . <br />Although there is no financial warranty associated with the permitted acreage in Lost <br />Creek, Henderson no longer has any plans to disturb this area as part of the mining <br />process. Since this is valuable property that could be used to provide collateral for the <br />
