On
Monday, August 23, 2004, the U.S. Department of Energy (DOE), in joint effort with your office
and Cotter, examined the C-SM-18 and Wright Mine sites as they pertain to Cotter's requested
amendment. In summary, Cotter is requesting that approximately five acres of undisturbed
ground be deleted from the permitted area for the C-SM-18 Mine site and a like amount of
acreage, encompassing the Wright Mine site and the surface facilities associated with Cotter's
proposed mining activity, be added to the permitted area. Thus, the amendment's net effect is
zero acreage. Accordingly, DOE has no objection to the Colorado Division of Minerals and
Geology granting Cotter's request.
If you have any questions concerning this matter, please contact me at (970) 248-6004.
Sincerely,
Michael K.
