BOX 1769 <br />Grand Junction, CO 81502 <br />Re: Whitewater Pit 500, Permit No. M-1977-129, Acreage Reduction No. 2 (AR-2) Approval / <br />Dear Mr. Gardner: <br />On February 28, 2007, the Colorado Division of Reclamation, Mining and Safety approved your request for release of a <br />portion of the permit azea from further reclamation responsibility. <br />The permit area was reduced to 589.04 acres, through the release of 99.96 acres in this permit action. The amount of <br />acreage released (99.96) is different than the 100.83 acres requested for release, because of an error in the release request <br />indicating that Stage Y is 19.62 acres, when Stage Y is actually permitted as 18.75 acres. <br />Because the permit is not totally released, you are still liable for filing annual reports and fees. <br />If you have any questions, please contact me (970) 243-6368. <br />Sincerely, <br />.~~~ ~J <br />Steve S.
