Box 1849 Division Director <br />Grand Junction, Colorado 81502 / Natural Resource Trustee <br />RE: Delta Paving Gravel Pit,yPermit No. M-1998-105, Technical Revision No. 1 Adequacy Review `~ <br />Dear Mr. Settle: <br />DMG completed the preliminary adequacy review of your application for Technical Revision No. 1 (TR- <br />01) to Permit No. M-1998-105 for the Delta Paving Gravel Pit. The application canhot be approved Until <br />the following issues are adegLlately addressed. Please submit a response to the following issues as <br />soon as possible, but no later than March 14, 2005 so the decision due date set for March 28, 2005 can <br />be met. If your response or a written extension request are not received by March 14, 2005 this <br />application may be denied. <br />ADEQUACY ISSUES <br />According to the approved mine plan map, it appears that the topsoil stockpile is located <br />partially in the wetland in Phase VII. I don't recall noting this in the December 8, 2004 <br />inspection and don't think this is the case. Please verify that there has been no discharge of <br />material into a wetland and ensure the topsoil stockpile location is accurately illustrated on the <br />revised mine plan map. DMG recommends that the wetland be delineated on site, with highly <br />visible markers to minimize the chance for deposition of material into these "waters of the U. S." <br />2. Please note on the revised map that the scales are portable units, this will prevent confusion <br />during future bond calculation procedures as DMG generally does not include. portable features <br />in these calculated reclamation cost estimates. <br />3.
