4. Impacts to air quality and the production of dust. <br />Division's Response <br />The Reclamation Statute and the Rules adopted by the Board do not specifically address air <br />pollution issues; air quality issues are under the jurisdiction of the Colorado Department of Public <br />Health and the Environment, Air Pollution Control Division. <br />The quarry has a well that has been adjudicated for industrial use. A water truck will be used to <br />suppress dust within the quarry. Dust palliatives will be applied to the quarry access road. <br />5. If the amendment is approved, limit the term of the permit. <br />Division's Response <br />Mined land reclamation permits are by statute issued for the "life of mine," which is defined in the <br />Boazd's regulations as meaning and including "but is not limited to, those periods of time from when <br />a permit is initially issued, that an Operator engages in or plans to continue extraction of construction <br />materials, complies with the Act and these Rules, and as long as construction material reserves <br />remain in the mining operation." <br />6. Visibility of quarry affected land and quarry operations. <br />Division's Response <br />The Division and Board have no jurisdiction over visual impacts during mining. Visual impacts will <br />be mitigated post mining by reclamation including revegetation. The mine plan included in the <br />amendment does not propose to disturb any of the currently reclaimed quarry waste rock dumps. <br />The mine plan proposed will largely screen long term operations from the Coaldale view shed. If the <br />Board approves the amendment, here wilt be limited visible quarrying associated with this operation, <br />particulazly in the first few yeazs of operations. <br />7. Hours of operation. Noise from Operations. <br />Division's Response <br />Jurisdiction over these issues is vested with Fremont County. <br />III. ISSUES IDENTIFIED BY THE DIVISION <br />1. The estimated direct costs for reclamation provided in Exhibit L to the amendment application are <br />acceptable to the Division at this time, However, $151,737.00 indirect costs must be applied as detailed <br />on the attached cost estimating worksheet, bringing the total amount of bond required for the amended <br />permit, if approved by the Board, to $707,000.00. <br />2. The Operator will monitor each quarry blast with a minimum of one seismograph located between <br />the location of the blast and the nearest potentially affected building or structure that is not owned or <br />4 <br />
