Cattany <br />Division Director <br />Natural Resource Trustee <br />Permit No. M- <br />The Division of Minerals and Geology (the Division) has received your request for a one month <br />continuance for the Riverbend Reclamation Permit Amendment. The Division will continue the <br />application for one month. With the continuance, the new time frames for the adequacy review, Pre- <br />Hearing and Board Hearing will be as follows: <br />Since the Division has received formal objections to your Amendment application, the Division is <br />required to make a recommendation to the Mined Land Reclamation Board (NLRB) three working <br />days.prior to aPre-Hearing Meeting. This meeting has been re-scheduled for April 1, 2005, therefore, <br />the recommendation must be issued by March 28, 2005. Your responses to the adequacy review <br />concerns must be received by the Division by 9 am on March 14, 2005 to allow the Division time to <br />review the responses and prepare a recommendation to the Board. The Board hearing will be <br />scheduled for April 13 or 14, 2005. <br />Pleased be advised that the Aggregate Industries-WCR, Inc. 112c Amendment Application maybe <br />deemed inadequate, and the application may be recommended for denial on March 28, 2005, unless the <br />adequacy review items which wel•e sent to Lafazge on February 11, 2005 are addressed to the <br />satisfaction of the Division. If you feel that you can not respond to these items by 9 am on March 14, <br />2005, the Division can grant an extension to the decision date. This would be done upon receipt of a <br />written waiver of your right to a recommendation to the Board by the March 28, 2005 deadline, and a <br />request for additional time. This must be received no later than Mazch 28, 2005. <br />If you have any questions, please do not hesitate-to call.
