Reclamation Permit Application:
Dear Mr. Williams:
The Colorado Division of Minerals and Geology (DMG) has received your objection to the United Companies
of Mesa County Amendment Ol application to their 112 Reclamation Permit application. Therefore, in
accordance with Rule 2.7.1 of the Constmction Materials Rules and Regulations of the Colorado Mined Land
Reclamation Boazd (MLRB), aPre-Hearing Conference must be held within thirty (30) days after the close of
the public comment period. Since the public comment period closed on July 31,2002, the Pre-heazing
Conference must be held on or before August 30,2002. Please contact me so we can arrange a time and place
for this Conference. You can call me at [phone].
The purpose of the Pre-Hearing Conference is to describe the Office's review process, to explain the rights and
responsibilities of parties, to discuss and resolve issues to the extent possible, to describe the Boazd Hearing
processes, to determine the list of issues under the Board's jurisdiction and to simplify the list, and to determine
who has demonstrated standing to be a party to the Formal Boazd Hearing.
The staff will schedule this matter for a Formal Public Heazing before the Colorado Mined Land Reclamation
Board. It is anticipated that this Hearing will be held on September 18 or 19, 2002. You will be notified of a
more precise time when this item is scheduled.
Please review the enclosed informational memo, dated October 2, 2001, RE: Citizen Participation in the 112
Reclamation Permit Application Process Revised October 19, 2001, and complete either of the last two pages, if
applicable, and return any completed forms [o [he DMG or bring them [o [he Pre-Hearing Conference. Also,
please note, as described in Rule 2.7.1(4) of the Constmction Materials Rules and Regulations, that "Any pally
that does not attend the Pre-hearing Conference forfeits their party status and all associated rights and privileges,
unless such party provides a fully executed proxy authorization form to the Pre-hearing Conference Officer and
the parties' authorized representative is present. However, a party may attend the Pre-hearing Conference via
telephone if such a request is made to the Pre-hearing Conference Officer, or a representative, at least five (5)
working days prior to the scheduled Pre-hearing Conference date, and facilities at the site of the Pre-heazing
Conference allow for a conference call."
