Your recent letter dated July 2nd, 2004 outlines 5 questions <br />that need to be clarified. Please refer to the attached copy of that letter while I <br />respond to those questions. <br />1) Yes, Pathfinder is the fee simple title holder to all of the adjacent off-permit <br />area. <br />2) Yes, these two activities are related and will happen simultaneously. <br />Some of the knob will be used as fill material to accommodate the <br />relocated road and wetland. <br />3) The portion of the existing road that will no longer serve as access to the <br />permitted property will be reseeded and boulders are to be placed at each <br />end, though not on top of the penstock. <br />4) Please refer to the attached Army Corps letter dated May 20`", 2004 and <br />the San Miguel County Planning Department Development Permit dated <br />October 9«, 2003. These are the necessary permits required by both of <br />these agencies to complete this project. <br />5) Please refer to the LANDesign Detention Pond & Storm Sewer Plan <br />included with this submission. The wetland swale will be used to contain <br />the upslope drainage from the East. This swale will be sloped so as to <br />
