An important issue from the perspective of this office that must be discussed at this time is the resolution of your <br />concern. During the public comment period of an amendment application review, this agency is required to accept <br />and respond to written letters of objection. Your letter was received during the public comment period, it involves <br />an issue that falls within our jurisdiction, and it may be interpreted to constitute a letter of objection. When such a <br />letter of objection is received, the sender of that letter is considered a "party," the application process changes. One <br />addition to the process is that conferences and hearings are scheduled to resolve the jurisdictional issues of the <br />objection, with at least one of those public hearings occumng in Denver before the Mined Land Reclamation <br />ESoard. Being a party in this type of matter carries with it certain responsibilities, as well as legal liabilities if this <br />ever went to court. <br />Please be aware that at this time that this office is required to consider your letter to be a letter of objection, and <br />consider you to be a party in this matter. Durine our tel~hone conversation I believe you stated that your letter <br />_vvas not really intended to be an objection, but that is a sentiment that we must have in writing. If, in fact, you do <br />not wish to object to the amendment anolicafion, and do not wish to be a party in this matter, please mail or fax a <br />note explaining that you wish to withdraw your objection.
