In response to your <br />comment letter dated October 22, 2003, please note that the Division has required, in Stipulation No. 3 of its <br />approval letter, that the operator shall not mine any of the Phase 3 area until the wetland issues aze resolved <br />with the Corps of Engineers and the Division (has) received a letter from the Corps stating what the resolution <br />is.
