MINING PLAN <br />Staying Within Transportation Corridors: <br />REQUIREMENT: Within land affected by this operation, driving off of designated roads <br />and access corridors will be prohibited, if that land contains significant noxious weed growth. Land <br />shown as being infested by noxious weeds on the most current version of Exhibit C-6 are considered <br />to have significant noxious weed growth. If in doubt check. THIS REQUIREMENT APPLIES TO <br />ALL VEHICLES, PRIVATE OR GOVERNMENT, THAT ENTER LAND AFFECTED BY THE <br />MINING ACTIVITY. This shall not be construed to limit activities of other lessees on this property or <br />ordnance removal work. But within all affected land, this requirement applies to all parties. It is hoped <br />that a policy similar to this will be implemented for all parties entering this land, but that is not this <br />operator's responsibility. The applicant and lessee has no right to limit access by other lessees and <br />will therefore not be responsible for damages created by other lessees or the impact of the actions of <br />other lessees within lands that have not been affected by this operation. Affected land shall include all <br />mining land, all land used for processing and stockpiling, and all land in the process of being <br />reclaimed. <br />Discussion: As required in the lease, transportation comdors will be treated to eliminate <br />noxious weeds near the roadway. Although the roadways do not appear to be a major distribution <br />pathway for weed spread throughout the site, especially in uplands, they are nevertheless significant. <br />In the process of controlling the weed population, maintaining containment boundaries around the <br />infestations near affected land is vital to the success of the program. <br />EXCEPTION: For emergency purposes (to control fires, repair flood damages, reclaim an <br />isolated disturbance, etc.) this requirement shall not apply. However, because such actions may also <br />breach containment lines, subsequent weed control efforts maybe required to establish any <br />containment lines again. <br />Oil and Gas Well Setbacks and Utility Setbacks: <br />REQUIREMENT: No mining or other disturbance that will disrupt the surface of the land <br />can occur within 200 feet of existing gas or oil wells, oil or gas pipelines, or water wells or waterlines. <br />Affecting land closer than 200 feet is only allowed after permission is obtained from the well or <br />pipeline owner and the additional disturbance is also approved by the Colorado State Board of Land <br />Commissioners and the Division of Minerals and Geology (or Mined Land Reclamation Board). This <br />also applies to overhead power lines with respect to mining but not necessarily other uses of the land <br />in the mining operation. Driving over buried pipelines (oil, gas, or water) will be allowed on <br />Coal Creek Sand Resource Amendment 3 (2005) - M-1988-044 Exhibit D Page 18 <br />
