MINING PLAN <br />because the overburden was too deep to make mining economically feasible. It appears the sand <br />deposits that are near the surface on the western flank of the ridge separating Coal Creek and Box <br />Elder Creek continue on the east flank of the ridge. But on the highest portions of the ridge the sand <br />deposit is rarely near enough the surface to make it economical to mine. There it appeazs to be capped <br />by a thick layer of soil and fine, very dirty sand that is probably of aeolian origin. In general the <br />upland sand deposits appear to trend along a southeast to northwest line. Lowland deposits more <br />closely parallel the current Coal Creek channel corridor. Whether this means Coal Creek, in the far <br />distant past, flowed more northwesterly than it does today cannot be determined. <br />Permit Boundary vs. Affected Land Boundary vs. Bonding Boundary <br />Permit Boundary Definition: The Permit Boundary described in Exhibit A is defined by and <br />derived from the lease (GL-264) issued by the Colorado State Board of Land Commissioners. The <br />permit includes all land included in the lease. The acreage of the permit boundary is derived from the <br />lease document. Because the acreage in the lease document is based on an assumption that a section of <br />land contains exactly 640 acres, the actual acreage of the permit, as determined by mapping, may <br />differ from this acreage. This is because sections are rarely 640 acres. In the past there has been <br />confusion over what the permit acreage of the operation actually is. This confusion resulted from <br />sometimes using mapped acreage and sometimes using the lease defined acreage. The difference in <br />acreage is not great. However, by defining the permit boundary in accordance with actual section lines <br />as stated in the lease, the description of the permit boundary becomes definable on the ground. <br />REQUIREMENT: No land maybe affected outside the permit boundary without prior <br />approval. <br />Affected Land Definition: Affected land is any land used or disturbed in the course of <br />conducting the mining operation. This includes not only mining areas, but processing areas, stockpiles <br />of various types, and access roads. In general, any disturbance created by the mining operation and its <br />associated activities is affected land. <br />However, as described in the Reclamation Plan (Exhibit E), some work will be performed by <br />the operator that will not actually be part of the mining operation and is therefore not affected land. <br />This work has been defined by agreement with the State Land Board and includes various <br />rehabilitation efforts primarily in drainages. This work is intended to improve the condition of the <br />land to meet the various goals of the Stewardship Trust classification of this land. In the course of the <br />operation, primarily on annual reports, this rehabilitation work will be defined on annual report maps <br />and described.
